Mexico Trust Services — Fideicomiso Setup for Foreign Buyers
Mexico Trust Services (operated by Special Circumstances LLC of San Ysidro, California) helps foreign nationals — primarily U.S. and Canadian buyers — establish a Mexican bank trust (fideicomiso) to legally purchase real estate in Baja California's restricted zone.
Mexican law forbids foreign nationals from holding direct title to property within the restricted zone (within 100 km of any border or 50 km of any coastline). The legal workaround is a fideicomiso: a 50-year renewable bank trust where a CNBV-authorized Mexican bank holds legal title and the foreign buyer is the beneficiary with full rights to use, lease, improve, sell, or pass the property to heirs.

Authorized Fiduciary Banks
We work with six fiduciary options:
- BIM — Banco Inmobiliario Mexicano (real-estate-specialist trust bank)
- Mifel — Banco Mifel
- Banorte — Banco Mercantil del Norte
- HSBC México
- BBVA México
- Escritura (direct deed) — for properties outside the restricted zone
How It Works
- Submit an application online with your details, property information, and chosen bank.
- Verify your email and phone with one-time codes.
- Provide required documents (passport, proof of address, property documents, etc.).
- We coordinate with the SRE (Secretaría de Relaciones Exteriores) for the trust permit.
- The chosen Mexican bank issues the trust contract.
- A Mexican notary executes the trust deed at closing.
- You become the named beneficiary of the fideicomiso, with full rights to your property.
